The foregoing will not apply to direct damages to you intentionally caused by us in violation of this agreement or applicable law, or as otherwise mandated by applicable law that cannot be disclaimed by this agreement.

9. Release

Some countries restrict or prohibit the limitation or exclusion of liability in consumer contracts, so some of the terms below may not apply to you.

By entering into this agreement, you voluntarily provide a binding release, waiver, and covenant not to sue (the “Release”) in favor of:

(i) Amber Bechard

(ii) its employees, contractors, and agents,

(iii) its shareholders, officers, and directors, and their heirs, legal representatives, successors, and assigns (collectively, the “Releasees”).

You acknowledge and accept the inherent risks associated with participating in any class, program, or activity provided by Amber Bechard. In consideration of the services, access to content, and use of facilities, you waive any and all claims against the Releasees for injuries, death, or property damage that may arise from your participation—regardless of cause, including negligence or failure to supervise.

This Release extends to your heirs, executors, administrators, and assigns. You also agree to comply with all rules and policies set by Amber Bechard while participating in its offerings.

10. Limited License Agreement

When you purchase a program, service or product (“Product”), you are granted a single-user, non-transferable license for personal use during the specified access period. Ongoing access is not guaranteed, and we reserve the right to modify or remove content at any time.

Reproducing, sharing, uploading, or redistributing any part of the Product or related materials—whether on file-sharing sites or otherwise - is strictly prohibited and will be treated as theft, subject to legal action.

All Products and related content (including website materials) are protected by copyright, trademark, and intellectual property laws and remain the sole property of Amber Bechard. You are granted a limited license for personal, noncommercial use only. 15. Payment Plans and Delinquent Status

Your program application or checkout submission—including your chosen payment plan—is a binding part of this agreement.

You agree to fulfill your payment obligations and confirm that all personal information provided is accurate and up to date.

Your initial payment is required upon enrollment in the Adrenal Support Strategy program. If you select a payment plan at checkout, subsequent payments will be automatically charged on the same day each month until the full balance is paid.

All payments must be current before the Program begins. Continued access to the Program is dependent on timely payments. If a scheduled payment is missed, your status will be marked as “delinquent,” your access to the Program will be suspended, and your eligibility to receive a certificate of completion may be forfeited. Missing assignment deadlines due to delinquency will disqualify you from certification and no refunds will be provided.

Failure to complete all required payments before the Program start date will result in loss of access to course materials and forfeiture of any refund.

However, payments already made may be applied as a credit toward the next offering of the Program, with the remaining balance payable in full upon re-registration. This policy is strictly enforced and no exceptions will be made.

16. Dispute Resolution and Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. This applies regardless of your country or province of residence.

If you breach, or are likely to breach, any part of this agreement, Amber Bechard reserves the right to seek injunctive or other urgent legal relief in any applicable jurisdiction, in addition to all other remedies available.

You agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply to this agreement. No choice of law provisions from other jurisdictions will be applicable.

Both parties waive any right to a jury trial for any dispute arising from or related to this agreement. You also consent to the exclusive jurisdiction of the courts located in Vancouver, British Columbia for resolving such disputes.

If any provision of this agreement is deemed unenforceable or invalid, the remaining provisions will continue to be in full effect.

A failure by Amber Bechard to enforce any part of this agreement at any time does not waive its right to enforce that or any other part in the future.

You agree to reimburse Amber Bechard for any legal fees and costs incurred in enforcing this agreement or collecting unpaid balances.

Unless explicitly agreed to in a signed physical document by an authorized officer or director, no statement, consent, waiver, or other action by Amber Bechard will be legally binding.

17. Entire Agreement and Modifications

This agreement—including the Privacy Policy and Terms and Conditions—constitutes the complete understanding between you and Amber Bechard with respect to the subject matter and replaces all prior proposals, communications, or agreements, whether written, oral, implied, or express.

Amber Bechard reserves the right to modify this agreement at any time at its sole discretion. If material changes are made, we will post the updated agreement on our website and notify you by general site notice or email.

If you do not accept the updated terms, your sole recourse is to discontinue your enrollment and access to the services. Your continued use of the website or services after notice of changes constitutes your binding acceptance of the modified agreement. All future purchases and use of services will be subject to the updated terms.
